Our Policies and Procedures
Dynastar Energy's Standard of Professional Behavior in Customer Acquisition:
- The Public Utility Commission (PUC), Attorney General, ERCOT and other regulatory agencies strictly prohibit slamming and may carry criminal penalties for engaging in the unauthorized transfer of a customer's energy service from the current service provider to a new energy company. The slamming of a customer to DE's service is against DE's policies and will result in immediate termination and forfeiture of all commissions. In addition, DE may take legal action against such Associate to recover real or consequential damages.
- Associates must take care to use the following procedures to avoid slamming: (i) verify by matching the name and ESI-ID against the actual energy bill, (ii) verify that the person completing the request for service has authority to change energy providers on behalf of the person whose name appears on the energy bill.
- Forging a signature on any document or signing on behalf of another without proper authorization is illegal and strictly prohibited.
- Using DE's name or logo without prior written consent in print or online advertising is strictly prohibited.
- Making untrue, false or misleading statements about DE's services or marketing plan is strictly prohibited.
- DE has the sole right to accept or reject orders for products and services, to establish and change without notice the rates and terms of service; therefore, Associates must stay familiar with these changes and fairly represent the current offerings and disclosures as required.
- Associate must keep and maintain accurate records and are encouraged to print and keep copies of service agreements and avoid any misleading, deceptive or unethical practices.
Dynastar Energy's Standard of Professional Behavior in Recruiting Associates:
- An Associate will not be permitted to own or have an interest in more than one position in any form.
- No individual may sign or register a position on behalf of another individual. An Associate will not provide false or invalid Social Security Numbers or Federal Employer Identification Numbers. Any such actions will be cause for immediate termination.
- An Associate may not solicit an individual currently sponsored by another Associate or who is already considering joining Dynastar Energy and being sponsored by another Associate.
- DE strictly prohibits during the term of this agreement, and six months thereafter, any Associate from the solicitation of another Associate currently sponsored by another individual in the DE program to participate in a business opportunity program offered by any other company, regardless of whether or not such company offers services that are competitive to those offered by DE. Associates must not do anything that would be deemed to interfere with the sponsor relationships of other Associates.
- DE and Affordable Power have a binding relationship to protect its prospective business'. DE strictly prohibits any associate from acting as a brokering agent in any capacity during its relationship as an Independent Sales Associate and within a period of 365 days after termination of his/her Independent Sales Associate position. Any individual or entity found doing so will immediately be terminated by Dynastar Energy and Affordable Power, forfeiting any and all commissions, bonuses, etc. owed.
- All promotional and training materials must be reviewed and approved by Dynastar Energy in writing prior to use by any Associate. Associates may only use DE-approved presentation formats and will not be permitted to charge guest entry fees for any presentation or training events.
- DE will maintain protection of the Associate relationship with his or her sponsor. Therefore, changing sponsors is strictly prohibited. An Associate may rejoin DE under a different sponsor only after a period of at least one year after an accepted resignation. Any violation of this rule or circumvention, including cross-recruiting, can result in suspension or termination of all Associate positions involved.
- DE requires that the sponsor of an Associate assist new Associates in training and enrolling new customers and new Associates. This activity will ensure the success of the business. When you launch your IPO, you are responsible for supervising, training and supporting Associates in your commissionable downline.
- Any Associate found making false or misleading statements about the DE Marketing Program will be subject to immediate termination.
